OccuFertility is developed and operated by Her Holistic Health Ltd, a company registered in England and Wales. Our contact address is info@herholistichealth.co.uk.

We are registered with the Information Commissioner's Office (ICO) under registration number ZB841609.

OccuFertility is an information resource and self-advocacy tool. It is designed to help employees understand their situation, structure conversations with their GP, line manager, and occupational health team, and access relevant UK workplace guidance.

OccuFertility is not a medical device. It does not diagnose, treat, monitor, or prevent any medical condition. It does not replace the advice of a qualified medical or legal professional. Nothing on the platform constitutes clinical advice, and nothing should be relied upon as a substitute for a consultation with your GP, specialist, solicitor, or other qualified adviser.

The clinical content is authored by Dr Divpreet Sacha (MBChB MRCGP DipOccMed) for educational and informational purposes only. It reflects general clinical knowledge and is not tailored to your individual circumstances.

OccuFertility is intended for use by adults aged 18 and over. By creating an account or using the platform, you confirm that you are at least 18 years old and that you have the legal capacity to enter into these Terms.

The platform is intended for use in the United Kingdom. We make no representation that the content is appropriate or available for use in other jurisdictions.

Access to the OccuFertility Toolkit requires a user account, created using your email address and a password. You are responsible for keeping your login details secure, your email address up to date, and for ensuring your account is not accessed by others.

You may not share your account or access code with anyone else. If your access was provided through an employer or clinic access code, it is for your personal use only.

We reserve the right to suspend or close an account if we have reasonable grounds to believe these Terms have been breached.

Some access to OccuFertility is provided through access codes issued by an employer, clinic, or partner organisation under a commercial licence. If you have redeemed such a code, your access is subject to the terms of that licence.

Employers and clinic partners access employer-level insights and administrative tools under a separate commercial licence agreement with Her Holistic Health Ltd. That agreement governs the commercial relationship; these Terms govern use of the platform itself.

Employer-level data is always aggregated and anonymised. Individual employee responses are never shared with an employer.

Data protection for organisational accounts. If you use OccuFertility as an employer or clinic administrator, Her Holistic Health Ltd acts as a data processor for the employee or patient data that you control as data controller. A Data Processing Agreement (DPA) is available on request and must be in place before an organisational account is activated. To request a DPA, contact info@herholistichealth.co.uk.

You agree not to:

• Use the platform for any unlawful purpose
• Attempt to access another user's account or data
• Scrape, copy, or republish platform content without our written permission
• Introduce malicious code or attempt to compromise the platform's security
• Misrepresent the platform's outputs as clinical or legal advice
• Use the platform in any way that could harm other users or Her Holistic Health Ltd

All content on OccuFertility - including clinical text, tools, templates, and design - is owned by or licensed to Her Holistic Health Ltd. You may use the platform and its outputs for your own personal, non-commercial purposes (for example, sharing a generated GP summary or manager brief with the relevant professional).

You may not reproduce, redistribute, or commercialise any part of the platform content without our prior written permission.

You retain ownership of content you create on the platform, including your assessment responses and generated documents. By using OccuFertility, you grant Her Holistic Health Ltd a limited licence to process that content solely for the purpose of delivering the service to you.

What data we collect. We collect the information you provide when creating an account and using the platform (including check-in responses, stage information, and settings), and technical usage data (such as pages visited and error logs).

Lawful basis. We process your personal data on the basis of your consent (Article 6(1)(a) UK GDPR). Fertility and health information is a special category of data under data protection law (Article 9 UK GDPR). We rely on your explicit consent (Article 9(2)(a)) to process this data. You can withdraw consent at any time by deleting your account.

How long we keep data. Your health data is kept for up to 12 months from your last check-in, after which it is automatically deleted. If you delete your account, your personal data is removed within 30 days. Anonymised aggregate data that cannot identify you may be retained indefinitely for research and improvement purposes.

Who we share data with. We use the following sub-processors to deliver the service: Supabase (database and authentication), Resend (email delivery), and Vercel (hosting). These providers process data only on our instructions and under data processing agreements. We do not sell your data or share it with third parties for marketing.

Your rights. You have the right to access, correct, or erase your data, to object to processing, and to data portability. To exercise any of these rights, contact us at info@herholistichealth.co.uk. You also have the right to lodge a complaint with the ICO at ico.org.uk.

To the fullest extent permitted by law, Her Holistic Health Ltd will not be liable for any loss or damage arising from your use of OccuFertility, including any reliance on information provided by the platform.

We do not warrant that the platform will be uninterrupted, error-free, or that any particular result will be achieved. We may update or withdraw content at any time without notice.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

We aim for high availability but do not guarantee that OccuFertility will be uninterrupted or error-free. Where we plan maintenance that will affect service, we will notify you at least 24 hours in advance where possible. No compensation is payable for downtime.

Her Holistic Health Ltd is not liable for failures or delays caused by events outside our reasonable control, including cloud infrastructure failures, cyberattacks, internet outages, or changes in applicable law or regulation.

If you use the medication reminder feature, email reminders are a convenience tool only. You remain solely responsible for taking your medications at the times prescribed by your clinical team.

For time-critical medications – including trigger injections and antagonists – do not rely solely on email as your reminder method. Email delivery is not guaranteed and may be delayed by spam filters, network issues, or other factors outside our control.

We are not liable for delays or failures in delivering reminder emails where such failures are caused by factors outside our reasonable control, such as spam filters or network outages. This clause does not limit our liability for death or personal injury caused by our negligence, or any other liability that cannot be excluded under English law.

You can opt out of dose reminders at any time via Settings.

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page.

For material changes, we will notify you by email at least 14 days before the changes take effect. Continued use of OccuFertility after that date means you accept the updated Terms. If you do not accept the new Terms, you may delete your account before the change takes effect.

These Terms are governed by the laws of England and Wales. Any disputes arising under them will be subject to the exclusive jurisdiction of the courts of England and Wales.
